Terms of Service

1. Acceptance of Terms

By accessing or using CardHavok ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms; continued use after changes constitutes acceptance. We will post the current Terms at this URL.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent or guardian's permission. By using the Service, you represent that you meet these requirements and have the authority to bind yourself (or your organization) to these Terms.

3. Account and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. We are not liable for losses from unauthorized access due to your failure to safeguard your credentials.

4. Acceptable Use

You agree not to:

• Violate any applicable law or regulation.
• Infringe others' intellectual property, privacy, or other rights.
• Use the Service for fraud, harassment, or to distribute malware or spam.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Scrape, crawl, or use automated means to extract data beyond normal use without our permission.
• Resell or commercially exploit the Service or data in a manner not permitted by your subscription.
• Interfere with or disrupt the Service or its infrastructure.

We may suspend or terminate your account for violation of these Terms or for any conduct we deem harmful to the Service or others.

5. Third-Party Services and API Compliance

The Service uses data and services from third-party providers. By using the Service, you acknowledge that your use is subject to our compliance with these providers' terms and that we display or process data in accordance with their policies where applicable.

• eBay. We use the eBay Developers Program APIs to show completed listings and market context. Our use is limited to promoting and facilitating access to eBay services. We comply with eBay's API License Agreement, User Agreement, and policies. eBay's terms: eBay API License Agreement.
• PriceCharting. We use the PriceCharting API for price data and sales volume. We use this data for internal service display and do not redistribute or resell raw PriceCharting data. We keep authentication tokens confidential. PriceCharting terms: PriceCharting Terms of Service.
• TCGdex / Pokémon TCG data. Card information and images are sourced from TCGdex and related APIs. We are not affiliated with, endorsed by, or sponsored by Nintendo, The Pokémon Company, Game Freak, or Creatures. TCGdex: TCGdex Terms.
• Stripe. Payments and subscriptions are processed by Stripe. By subscribing you agree to our subscription terms; payment processing is also subject to Stripe's terms. We do not store your full payment card details. Stripe: Stripe Services Agreement.
• PSA and grading data. Grading and population data (e.g., PSA) may be sourced from public or third-party APIs for informational purposes. We do not guarantee the accuracy of grading or population figures and are not affiliated with PSA or other grading companies. Use of certification lookups may be subject to the respective provider's terms.

You agree not to use the Service in any way that would cause us to violate these third-party terms or that would misuse or misappropriate third-party data (e.g., scraping, reselling raw API data, or circumventing rate limits).

6. Subscriptions and Payment

Paid subscriptions (e.g., Pro, Premium) are billed through Stripe. By subscribing, you authorize recurring charges per the plan you select. Fees are in U.S. dollars. You may cancel at any time; cancellation will take effect at the end of the current billing period. We do not provide refunds for partial periods or unused time, except where required by law. We may change subscription fees with reasonable notice; continued use after a fee change constitutes acceptance.

7. Disclaimers

Service "as is." The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

Third-party data. Card data, market prices, and insights are supplied by third parties (including TCGdex, PriceCharting, eBay, TCGPlayer, Cardmarket, PSA or other grading sources, and social or community data). We do not guarantee the accuracy, completeness, or timeliness of such data. Prices and trends are for informational purposes only. Availability of third-party data may change without notice.

Not financial or professional advice. Nothing in the Service constitutes investment, tax, legal, or professional advice. You are solely responsible for your collecting and purchasing decisions.

8. Limitation of Liability

To the maximum extent permitted by law, CardHavok LLC and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or use, arising from or related to the Service or these Terms, even if advised of the possibility of such damages. Our total liability for any claims arising from or related to the Service or these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred U.S. dollars ($100), whichever is greater. Some jurisdictions do not allow limitation of certain damages; in such jurisdictions, our liability will be limited to the fullest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless CardHavok LLC and its affiliates and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause or notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (including disclaimers, limitation of liability, indemnification, and governing law) will survive termination.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. You waive any claim that such courts are an inconvenient forum.

12. General

• Entire agreement: These Terms, together with our Privacy Policy and any subscription or plan terms, constitute the entire agreement between you and CardHavok LLC regarding the Service.
• Severability: If any provision is held invalid or unenforceable, the remaining provisions will remain in effect.
• No waiver: Our failure to enforce any right or provision is not a waiver of that right or provision.
• Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.
